INSURANCE WORKERS EMPLOYED IN MINING ACTIVITIES, ACCIDENTS AT WORK

Pursuant to Article 100 of the Constitution, Articles 6 and 40 of Law 7961, dated 12.07.1995 “The Labour Code of the Republic of Albania”, as amended, and Articles 91 and 93 of the law no.7796, dated 17.2 .1994 “Mining Law of Albania”, as amended, the proposal of the Minister of Economy, Trade and Energy Council MinistraveVENDOSI: 1. Persons in possession of a permit to conduct exploration within the Republic of Albania, forced to carry insurance for their employees from personal accidents at work, under a contract with an insurance company.

2. The insurance contract employees from personal accidents at work should cover cases:
3. a) loss of life;
4. b) permanent disability, full or partial;
5. c) temporary disability, full or partial.
6. The amount for each employee to provide, as defined in the form of the insurance contract can not be less than 6,000,000 (six million).
7. Premium insurance fee can not be lower than 0.5 percent of the sum insured, recorded in the form of the insurance contract.
8. The standard conditions of the insurance contract, including the table of coefficients of profitability, according to health damage, approved by the Financial Supervisory Authority, based on paragraph 8 of Article 14 of Law No. 9572, dated 3.7.2006 “Supervisory Authority Financial “. These conditions serve as the minimum required to be implemented by insurance companies for insurance of employees, in accordance with paragraph 1 of this decision.
9. Period of mining activity, defined by mineral rights, acquired the mining permits, should be covered by the insurance contract, which can be renewed annually and each year or for the duration of the mining activity.
10. Mining entities, which will be equipped with mining licenses under the mining law requirements Albania must carry accident insurance of the workers before the start and during their exercise of mining.
11. The mining subjects, equipped with a mining permit and conducting mining activities, within a period of 90 days from the date of entry into force of this Decision, must realize providing employees with accidents.
12. Mining entities must submit to the responsible bodies in the Ministry, covering the mining, documents proving insurance against accidents. The beginning or continuation of mining activity carried out after confirmation of these structures that provision is in accordance with the requirements of this decision.
13. The company will not conduct mining activities up to the time of presentation and adoption of this document by the body that issued the mining permit. Violation of such an obligation assessed violations to the law no.7796, dated 02.17.1994 “Mining Law of Albania”, as amended, and treated, according to punitive measures chapter of this law, the value of the maximum fine and removal mineral rights.
14. The Ministry of Economy, Trade and Energy to implement this decision.

This decision shall enter into force after its publication in the Official Journal.
